What the fee includes
A private mediation fee typically covers the mediator's preparation (reviewing documents and financial information in advance), the session itself, and an agreement summary if the matter resolves. Legal advice, consent orders, and lawyer attendance are separate.
How costs are split
Mediation costs are generally shared equally between the parties. This is negotiable — in some commercial matters, the party that initiated the dispute bears a larger share. In workplace matters, an employer often covers the full cost as part of a workplace investigation or HR response.
The cost of not mediating
A contested family court matter typically costs $20,000–$100,000 per party. A commercial litigation matter can run well beyond that. Mediation resolves most matters in one day at a fraction of that cost. See our fee structure for current rates.
