What drives the cost of commercial mediation?
| Cost factor | Typical range |
|---|---|
| Mediator daily rate (experienced) | $4,000–$12,000 + GST |
| Mediator daily rate (senior barrister/retired judge) | $10,000–$25,000 + GST |
| Venue (if not included) | $500–$2,000 per day |
| Your legal representation | $3,000–$10,000+ per day (if instructed) |
| Preparation (briefs, position papers) | $2,000–$5,000 (billed by your lawyers) |
How costs are split
In commercial mediation, the mediator's fee is typically split equally between the parties — each pays half. Parties bear their own legal representation costs. Where a mediation clause in a contract specifies the cost split, that clause governs.
Is commercial mediation cheaper than litigation?
Almost always. A commercial dispute that reaches hearing in the Supreme Court or Federal Court commonly costs each party $150,000–$500,000+ in legal fees over two to four years. A one-day commercial mediation that resolves the matter costs a fraction of this — even accounting for preparation time and legal representation at the session.
Court-ordered mediation
Courts in NSW, Victoria, and other states routinely order commercial disputes to mediation before hearing. Court-annexed mediation may be provided at a reduced cost or no cost through the relevant court's dispute resolution scheme, though wait times are generally longer than private mediation.
Worked example
A contract dispute between two businesses worth $800,000. Both parties instruct solicitors. Private commercial mediator at $8,000/day (split equally: $4,000 each). Each party's solicitor attends at $3,500. Preparation $1,500. Total per party: approximately $9,000 — compared to $120,000+ each if the matter proceeds to a two-day Supreme Court hearing with barristers.
When is a more expensive mediator worth it?
For large or technically complex disputes, a senior mediator — a retired judge or senior commercial barrister — can command $15,000–$25,000 per day. Their authority, experience, and commercial judgment often produce better outcomes faster in high-stakes matters, making the premium cost-effective overall.
